This Privacy Policy applies to www.ornafish.com (the Website) and the Ornafish mobile app for iOS and Android (the App), operated by Ornafish Japan Co., Ltd. (we or us). Contact us about privacy or account and personal data deletion at info@ornafish.com.

The Website and App let visitors browse our products and services, contact us or a selected dealer, and let approved dealers access ordering, auctions and account services.

Ornafish Japan Co., Ltd. is the data controller responsible for the collection and use of personal data through the Website and App. You can contact us using the details in section 8.

The following policy explains the different elements of personal data that will be collected, the purposes of collection, any sharing of that data with third parties, your rights as the data subject and the measures taken to protect your personal data.

This policy covers information you provide, information used to operate your account and transactions, and technical information collected when you use our services. The Cookie Policy below describes cookies on the Website; the mobile app section describes data used by the App.

1. PERSONAL DATA WE COLLECT

When you use the Website, we process the following information:

• Cookies: this covers data on when you access the Website, any personalized settings, and your browsing behaviour. We collect this information through automated means as you browse the Website. You will be asked to consent to the use of cookies through a Cookie Banner. Cookies are necessary to optimize navigation and your browsing experience, for more information see our Cookie Policy.
• Identification data: information you submit in contact forms, dealer applications or your dealer account, including your name, email address, telephone number, company details, business address and registration or VAT information where requested.

You choose whether to submit forms and use account services. Information marked as required is needed to handle the request or transaction. Technical information described in this policy is also collected when you use the services.

We will only use your data for marketing purposes if and after you expressly consented to it. You can always withdraw consent (see hereunder section 4.3).

When you contact Ornafish through the Website or App, we process the contact details and message you submit to respond to your enquiry. App forms also use an installation identifier and submission records to limit repeated requests and help prevent spam.

1.1. Ornafish mobile app

Some app features are available without signing in. The following explains what is processed when you use the App, including when you are not signed in.

The App is intended for users aged 16 and over. Ordering and bidding are available only to approved dealer accounts.

• Accounts and activity: signing in links app activity to your dealer account and company. We process account details, cart and favourite selections, orders, bids, shipment information and claims to provide these services. Cart and favourites are shared with other users of the same dealer company and with its website account.
• App usage: the App sends a randomly generated installation identifier, session identifier, platform, app version, build and distribution channel to Ornafish. Session activity is recorded while the App is open, including for visitors who are not signed in. When you sign in, this information can be linked to your account and company so we can understand app usage.
• Notifications: Firebase Cloud Messaging provides push notifications using an app installation identifier and push token. Ornafish stores the token, platform and installation identifier and links them to your account when signed in. Notification read and deletion status is stored for the relevant account or installation. You can manage push permission in your phone settings.
• Dealer search: if you choose to use your current location and allow location access, the App uses your coordinates to sort dealers by distance. Your last location is stored on your device and the distance calculation happens there; these coordinates are not sent to the Ornafish API for dealer search. Alternatively, you can enter a city or postcode, which is looked up through the location service provided by your operating system.
• Claim photos: when you submit a credit claim, the photos you select, your explanation and the related order details are uploaded to Ornafish to handle the claim. The App accesses the photos you choose for that purpose. Product photos and videos can also be saved to your device when you request a download.
• On-device storage: the App remembers preferences such as language, filters, your chosen dealer and last dealer-search location. It also stores cached content, form drafts and sign-in information needed to keep the App working between visits.

2. HOW WE USE THE PERSONAL DATA WE COLLECT

We use the personal data you provide:

• To keep you informed of any developments linked to our products and services;
• To respond to any enquiries you may make;
• For direct marketing purposes (only if you agreed to it by ticking the relevant box);
• To evaluate and improve our Website and App;
• To comply with applicable legal requirements and industry standards;
• To perform auditing, research and analysis in order to maintain, protect and improve our services.

We retain order and invoice records for seven years. Account and personally associated app data are covered by the deletion-request process in section 4.2. Information needed to complete an outstanding transaction, resolve a dispute, or meet a justified security or legal requirement may need to be retained. When handling a deletion request, we explain any information we retain and why.

Since purchase of the koi is done in Japan, your data may possibly be processed outside the European Union.

3. PERSONAL DATA WE SHARE

We do not sell or otherwise disclose the personal data we collect to third parties, except as described in this Privacy Policy or as otherwise disclosed to you at the time of collection.

We may share personal data with affiliates or third parties who perform data processing activities on our behalf. As far as these service providers are acting as data processor, on our behalf, we do not authorize them to use or disclose the data in any way except as specified in this Privacy Policy. We require that these data processors appropriately safeguard the privacy and security of the personal data they process on our behalf.

App services include Google Firebase Cloud Messaging for push delivery, Cloudflare R2 for claim-photo and media storage, and Mandrill for transactional email delivery. These services process the information needed to deliver the corresponding function. The App also sends usage information directly to Ornafish as described above.

When you use Notify Dealer and send an interest request, your name, email address, telephone number and the selected item are emailed to the dealer you choose. The dealer receives these details so it can respond to your enquiry. The App explains this before you send the request.

Some item videos use an embedded YouTube player. Loading or playing this content connects your device to Google/YouTube, which can receive your IP address, device or browser information and playback activity under its own privacy policy. Google/YouTube may use your IP address to determine your general region and show non-personalised advertisements, including with privacy-enhanced playback. External pages and services opened from the App are also governed by their own privacy policies.

We may also disclose your personal data: (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or (iv) in connection with an investigation of suspected or actual fraudulent or illegal activity.

We also reserve the right to transfer any personal data in the event we would sell or transfer all or a portion of our business or assets. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use personal information you have provided to us in a manner that is consistent with this Privacy Policy.

4. EXERCISING YOUR RIGHTS

4.1. Access and Rectification

You can request access to or correction of your personal data by contacting Ornafish Japan Co., Ltd. at info@ornafish.com. Include the email address associated with your account or request so we can identify the relevant records. Do not send a password.

4.2. Account and personal data deletion

To request deletion of your Ornafish account or personal data, contact Ornafish Japan Co., Ltd. at info@ornafish.com or use the request form below. Identify the account or request concerned and tell us whether you want to delete the account, specific data, or both. Uninstalling the App does not itself delete information already held by Ornafish.

We handle deletion requests manually after verifying that the request relates to you. Account deletion includes your user account and its associated personal data, including personally linked app usage, notification registrations and request records, subject to the retention rules in section 2. Your dealer login is shared between the App and Website, so deleting that user account affects access to both.

A request to delete one user account does not delete the dealer company or another employee’s account. The company’s shared cart, favourites and business records remain available to its other authorised users. We review personally identifying information within those records separately from the company’s information.

If you used the App without signing in, support may need your app installation identifier to locate the correct installation records. An email address alone may not identify guest usage data. We will explain what is needed to handle your request; do not send passwords.

4.3. Objection

When visiting the Website you will be requested to consent to certain data processing activities. You have the right to withdraw your consent at all times.

To object to the use of your personal data for direct marketing, contact Ornafish Japan Co., Ltd. at info@ornafish.com. You can turn off app push notifications in your phone settings; this does not delete your account or other records.

Such withdrawal of consent will not affect the lawfulness of past data processing and it can, however, impact your continued use of the Website. Ornafish Japan Co., Ltd. cannot provide its services without processing necessary elements of your personal data.

5. HOW WE PROTECT PERSONAL DATA

We maintain appropriate administrative, technical and physical safeguards to protect personal data against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful forms of processing of the personal data in our possession.

The security measures we take vary depending on the type of data processed and how it is collected and/or stored. When you provide personal data online, we use the industry standard for encryption on the Internet – Secure Socket Layer (SSL) technology – to help protect the data that you provide. This Internet encryption standard scrambles data as it travels from your device to our server. We also use digital certificates to ensure that you are connected to authentic channels.

App usage records are included when we handle a verified request to delete an account or its associated personal data.
